City Council Votes 4 to 3 AGAINST appealing the recent court ruling in favor of PATHS!

At last night's Council meeting on March 2, 2021, City Council voted 4 to 3 to NOT appeal the Larimer County Judge's decision that court-ordered the City to try to purchase Hughes from CSU after Hughes is zoned Public Open Lands, should the Hughes Open Space ballot measure pass.

Avoiding further legal action will not only prevent additional waste of taxpayers' money, but it will also mean that citizen-funded PATHS will not have to engage in another costly defense of our sound ballot measure language, which has already prevailed in a court of law.

Please join us in saying thank you to those council members who stood with citizens, and voted in the best interests of taxpayers by voting AGAINST further legal action in the form of an appeal of the Judge's ruling.

Against appealing (Thank You!):

Ross Cunniff, Susan Gutowsky, Melanie Potyondy, Ken Summers

Those who voted in favor of additional legal action against citizens in the form of an appeal:

Julie Pignataro, Emily Francis (Gorgol), Wade Troxell

PATHS is grassroots and citizen-funded. Please consider a contribution to outstanding legal fees associated with the City’s legal action against the citizen-initiated ballot measure (which we won!). Thank you.
